1 A bill to be entitled
2 An act relating to clinical laboratory
3 services; amending ss. 627.6471, 627.6472, and
4 641.31, F.S.; requiring certain insurers and
5 health maintenance organizations to cover and
6 pay for certain clinical laboratory services
7 under certain circumstances; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (7) is added to section
13 627.6471, Florida Statutes, to read:
14 627.6471 Contracts for reduced rates of payment;
15 limitations; coinsurance and deductibles.--
16 (7) Any insurer which issues in this state a policy of
17 health insurance which includes coverage for clinical
18 laboratory services as defined in s. 483.041 shall cover and
19 pay for the services of any clinical laboratory to which a
20 specimen is directed by a preferred provider, without penalty
21 to such preferred provider.
22 Section 2. Subsection (19) is added to section
23 627.6472, Florida Statutes, to read:
24 627.6472 Exclusive provider organizations.--
25 (19) Any insurer which issues in this state a policy
26 of health insurance which includes coverage for clinical
27 laboratory services as defined in s. 483.041 shall cover and
28 pay for the services of any clinical laboratory to which a
29 specimen is directed by an exclusive provider, without penalty
30 to such exclusive provider.

1 Section 3. Subsection (39) is added to section 641.31,
2 Florida Statutes, to read:
3 641.31 Health maintenance contracts.--
4 (39) Any health maintenance organization which issues
5 in this state a health maintenance contract which includes
6 coverage for clinical laboratory services as defined in s.
7 483.041 shall cover and pay for the services of any clinical
8 laboratory to which a specimen is directed by a treating
9 physician, without penalty to such treating physician.
10 Section 4. This act shall take effect July 1, 2000.
