  1                      A bill to be entitled

  2         An act relating to rulemaking authority

  3         regarding aquatic plants (RAB); amending s.

  4         369.25, F.S.; authorizing the Department of

  5         Environmental Protection to adopt rules

  6         providing enforcement penalties, sanctions, and

  7         remedies for violations of part I of ch. 369,

  8         F.S.; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (4) of section 369.25, Florida

13  Statutes, is amended to read:

14         369.25  Aquatic plants; definitions; permits; powers of

15  department; penalties.--

16         (4)  The department shall adopt rules to provide

17  enforcement penalties, sanctions, and remedies for violations

18  of this part. Such enforcement penalties, sanctions, and

19  remedies may include the authority to require the revegetation

20  of a site on sovereignty lands where excessive collection has

21  occurred.  However, such rules must which limit the sanctions

22  available for violations under this act to quarantine and

23  confiscation:

24         (a)  If the prohibited activity apparently results from

25  natural dispersion; or

26         (b)  If a small amount of noxious aquatic plant

27  material incidentally adheres to a boat or boat trailer

28  operated by a person who is not involved in any phase of the

29  aquatic plant business and if that person is not knowingly

30  violating this act.

  1         Section 2.  This act shall take effect upon becoming a

  2  law.
