  1                      A bill to be entitled

  2         An act relating to sentencing; providing a

  3         short title; creating the "Sexual Predator

  4         Prosecution Act of 2000"; amending s. 921.16,

  5         F.S.; requiring an offender serving a sentence

  6         for sexual battery or murder who is found

  7         guilty of a separate offense of sexual battery

  8         or murder to serve a consecutive sentence for

  9         each separate offense; providing an effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Short title.--This act may be cited as the

15  "Sexual Predator Prosecution Act of 2000."

16         Section 2.  Subsection (1) of section 921.16, Florida

17  Statutes, is amended to read:

18         921.16  When sentences to be concurrent and when

19  consecutive.--

20         (1)  A defendant convicted of two or more offenses

21  charged in the same indictment, information, or affidavit or

22  in consolidated indictments, informations, or affidavits shall

23  serve the sentences of imprisonment concurrently unless the

24  court directs that two or more of the sentences be served

25  consecutively. Sentences of imprisonment for offenses not

26  charged in the same indictment, information, or affidavit

27  shall be served consecutively unless the court directs that

28  two or more of the sentences be served concurrently. An

29  offender serving a sentence for sexual battery as defined in

30  chapter 794 or murder as defined in s. 782.04 who is found

  1  guilty of a separate offense of sexual battery or murder shall

  2  serve a consecutive sentence for each separate offense.

  3         Section 3.  This act shall take effect October 1, 2000.
