1 A bill to be entitled
2 An act relating to the state group insurance
3 program; amending s. 110.123, F.S.; providing a
4 period of time during which certain retired
5 officers and employees may elect to participate
6 under the program; providing that former state
7 officers and employees who are vested in the
8 Florida Retirement System may participate in
9 the state group health insurance plan at the
10 time of receiving their state retirement
11 benefits; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Paragraph (f) of subsection (3) of section
16 110.123, Florida Statutes, is amended to read:
17 110.123 State group insurance program.--
18 (3) STATE GROUP INSURANCE PROGRAM.--
19 (f)1. Participation by individuals in the program
20 shall be available to all state officers, full-time state
21 employees, and part-time state employees; and such
22 participation in the program or any plan thereof shall be
23 voluntary. Participation in the program shall also be
24 available to retired state officers and employees who elect at
25 the time of retirement to continue coverage under the program,
26 but they may elect to continue all or only part of the
27 coverage they had at the time of retirement. A surviving
28 spouse may elect to continue coverage only under the state
29 group health insurance plan or a health maintenance
30 organization plan.

1 2. Commencing on July 1, 2000, there shall be a
2 one-time period of 90 days during which retired state officers
3 and employees who did not elect at the time of retirement to
4 continue coverage under the program may elect to participate
5 in the program with all or part of the coverage they had at
6 the time of retirement.
7 3. Notwithstanding s. 110.123(2)(g), former state
8 officers and employees who are vested in the Florida
9 Retirement System, and who have deferred receiving their state
10 retirement benefits until age 62 to avoid early retirement
11 penalties, may participate in the state group health insurance
12 plan at the time of receiving their state retirement benefits
13 on the same basis as a retiree defined in s. 110.123(2)(g).
14 Section 2. This act shall take effect upon becoming a
15 law.
