  1                      A bill to be entitled

  2         An act relating to health insurance; creating

  3         ss. 627.6410 and 627.65747, F.S., and amending

  4         s. 641.31, F.S.; requiring certain health

  5         insurance policies and health maintenance

  6         contracts to provide coverage for organ

  7         donations for transplant recipients; providing

  8         an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Section 627.6410, Florida Statutes, is

13  created to read:

14         627.6410  Coverage for organ donations.--Any health

15  insurance policy that covers a resident of this state and that

16  is issued, amended, delivered, or renewed in this state after

17  October 1, 2000, must provide coverage for donations by the

18  resident of his or her major or vital organs for transplant

19  recipients.

20         Section 2.  Section 627.65747, Florida Statutes, is

21  created to read:

22         627.65747  Coverage for organ donations.--Any group,

23  blanket, or franchise health insurance policy that covers a

24  resident of this state and that is issued, amended, delivered,

25  or renewed in this state after October 1, 2000, must provide

26  coverage for donations by the resident of his or her major or

27  vital organs for transplant recipients.

28         Section 3.  Subsection (39) is added to section 641.31,

29  Florida Statutes, to read:

30         641.31  Health maintenance contracts.--

  1         (39)  A health maintenance contract that covers a

  2  resident of this state and that is issued, amended, delivered,

  3  or renewed in this state after October 1, 2000, must provide

  4  coverage for donations by the resident of his or her major or

  5  vital organs for transplant recipients.

  6         Section 4.  This act shall take effect upon becoming a

  7  law.
