2 An act relating to dentistry; amending s.
3 466.004, F.S.; revising qualifications for
4 membership on the Board of Dentistry; providing
5 applicability; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. (1) Subsection (1) of section 466.004,
10 Florida Statutes, is amended to read:
11 466.004 Board of Dentistry.--
12 (1) To carry out the provisions of this chapter, there
13 is created within the department the Board of Dentistry
14 consisting of 11 members who shall be appointed by the
15 Governor and subject to confirmation by the Senate. Seven
16 members of the board must be licensed dentists actively
17 engaged in the clinical practice of dentistry in this state
18 whose principal source of income is derived from direct
19 patient care; two members must be licensed dental hygienists
20 actively engaged in the practice of dental hygiene in this
21 state; and the remaining two members must be laypersons who
22 are not, and have never been, dentists, dental hygienists, or
23 members of any closely related profession or occupation. Each
24 member of the board who is a licensed dentist must have been
25 actively engaged in the practice of dentistry primarily as a
26 clinical practitioner for at least 5 years immediately
27 preceding the date of her or his appointment to the board and
28 must remain primarily in clinical practice during all
29 subsequent periods of appointment to the board. Each member of
30 the board Any person who is connected in any way with any

1 s. 455.531 may be appointed to the board so long as that
2 connection does not result in a relationship wherein such
3 college provides more than 5 percent of the person's income.
4 At least one member of the board must be 60 years of age or
5 older. Members shall be appointed for 4-year terms.
6 (2) The amendment of subsection (1) of section
7 466.004, Florida Statutes, by this section applies to
8 appointments to the Board of Dentistry made on or after the
9 effective date of this act.
10 Section 2. This act shall take effect July 1, 2000.

13 HOUSE SUMMARY

Removes the provision that requires members of the Board
15 of Dentistry who are licensed dentists to derive their
principal source of income from direct patient care.
16 Revises the provision that authorizes appointment of
persons to the board who are connected with a dental
17 college or community college, to prohibit such
appointment only if the person's principal source of
18 income is provided by such college. Provides that such
provisions shall apply only to new appointments to the
19 board.
