11  Senator Cowin moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 3, line 12, through page 4, line 2, delete

15  those lines

17  and insert:

18         Section 1.  Subsection (4) is added to section 39.011,

19  Florida Statutes, to read:

20         39.011  Immunity from liability.--

21         (4)  RIGHTS OF CHILD PROTECTION AND CHILD WELFARE

22  WORKERS WHILE UNDER INVESTIGATION.--Whenever a child

23  protection worker or child welfare worker is under

24  investigation for any reason which could lead to disciplinary

25  action, demotion, or dismissal, resulting from alleged

26  wrongdoing in a child abuse, abandonment, or neglect case,

27  such investigation shall be conducted under the following

28  conditions:

29         (a)  The child protection worker or child welfare

30  worker shall be informed of the nature of the investigation.

31         (b)  The child protection worker or child welfare

 1  worker shall not be threatened with transfer, dismissal, or

 2  disciplinary action and shall be reassigned to another

 3  nonsensitive position with pay pending the outcome of the

 4  investigation.

 5         (c)  At the request of any child protection worker or

 6  child welfare worker under investigation, he or she shall have

 7  the right to be represented by counsel or any other

 8  representative of his or her choice, who shall be present at

 9  all times during the investigation whenever the investigation

10  relates to the worker's continued fitness for public service.

11         (d)  If the child protection worker or child welfare

12  worker under investigation is under arrest, or is likely to be

13  placed under arrest as a result of the investigation, he or

14  she shall be completely informed of all his or her rights

15  prior to the commencement of the investigation.
