1 A bill to be entitled
2 An act relating to regulation of firearms;
3 amending s. 790.33, F.S., relating to state
4 preemption of the field of regulation of
5 firearms and ammunition; providing that certain
6 ordinances, resolutions, or rules of local
7 government are not precluded with respect to
8 possession of weapons or firearms of public
9 employees or possession of weapons or firearms
10 on public property controlled by local
11 government, under specified circumstances;
12 providing an exception for certain street,
13 road, or highway rights-of-way; providing an
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Subsection (4) is added to section 790.33,
19 Florida Statutes, to read:
20 790.33 Field of regulation of firearms and ammunition
21 preempted.--
22 (4) LOCAL REGULATION OF FIREARM POSSESSION BY PUBLIC
23 EMPLOYEES OR ON PUBLIC PROPERTY.--
24 (a) This section does not preclude any ordinance,
25 resolution, or rule of any local government acting as an
26 employer which regulates or prohibits the possession of
27 weapons or firearms of public employees on the job, or areas
28 related thereto, during working hours, or during times related
29 thereto.
30 (b) This section does not preclude any local
31 government from enacting an ordinance or resolution that

1 prohibits the possession of weapons or firearms on public
2 property controlled by the local government, other than the
3 rights-of-way of streets, roads, or highways, but the local
4 government must prominently display a sign giving notice of
5 such prohibition.
6 Section 2. This act shall take effect upon becoming a
7 law.

Provides that specified provisions relating to state
12 preemption of the field of regulation of firearms and
ammunition do not preclude certain ordinances,
13 resolutions, or rules of local government which regulate
or prohibit possession of weapons or firearms of public
14 employees, under specified circumstances when the local
government acts as employer. Provides also that such
15 provisions do not preclude certain local ordinances or
resolutions prohibiting possession of weapons or firearms
16 on public property controlled by local government, under
specified circumstances. Provides an exception for
17 certain street, road, or highway rights-of-way.
