  1                      A bill to be entitled

  2         An act relating to license plates; amending s.

  3         320.089, F.S.; providing for the deposit of

  4         certain funds generated under s. 320.089, F.S.,

  5         into the Grants and Donations Trust Fund

  6         established by s. 296.38, F.S.; amending s.

  7         320.08058, F.S.; revising provisions relating

  8         to the Sea Turtle License Plate; providing for

  9         a distribution of 25 percent of the annual use

10         fees from the Share the Road license plate to

11         Bike Florida, Inc., rather than to the

12         Governor's Council on Physical Fitness and

13         Amateur Sports; providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16

17         Section 1.  Subsection (1) of section 320.089, Florida

18  Statutes, is amended to read:

19         320.089  Members of National Guard and active United

20  States Armed Forces reservists; former prisoners of war;

21  survivors of Pearl Harbor; Purple Heart medal recipients;

22  special license plates; fee.--

23         (1)(a)  Each owner or lessee of an automobile or truck

24  for private use or recreational vehicle as specified in s.

25  320.08(9)(c) or (d), which is not used for hire or commercial

26  use, who is a resident of the state and an active or retired

27  member of the Florida National Guard, a survivor of the attack

28  on Pearl Harbor, a recipient of the Purple Heart medal, or an

29  active member of any branch of the United States Armed Forces

30  Reserve shall, upon application to the department, accompanied

31  by proof of active membership or retired status in the Florida

  1  National Guard, proof of membership in the Pearl Harbor

  2  Survivors Association or proof of active military duty in

  3  Pearl Harbor on December 7, 1941, proof of being a Purple

  4  Heart medal recipient, or proof of active membership in any

  5  branch of the Armed Forces Reserve, and upon payment of the

  6  license tax for the vehicle as provided in s. 320.08, be

  7  issued a license plate as provided by s. 320.06, upon which,

  8  in lieu of the serial numbers prescribed by s. 320.06, shall

  9  be stamped the words "National Guard," "Pearl Harbor

10  Survivor," "Combat-wounded veteran," or "U.S. Reserve," as

11  appropriate, followed by the serial number of the license

12  plate. Additionally, the Purple Heart plate may have the words

13  "Purple Heart" stamped on the plate and the likeness of the

14  Purple Heart medal appearing on the plate.

15         (b)  Notwithstanding any other provision of law to the

16  contrary beginning with fiscal year 2000-2001 and annually

17  thereafter, the first $50,000 in general revenue generated

18  from the sale of license plates issued under s. 320.089 which

19  are stamped with the words "National Guard," "Pearl Harbor

20  Survivor," "Combat-wounded veteran," or "U.S. Reserve" shall

21  be deposited into the Grants and Donations Trust Fund, as

22  described in s. 296.38(2), to be used for the purposes

23  established by law for that trust fund.

24         Section 2.  Paragraph (b) of subsection (19) and

25  paragraph (b) of subsection (31) of section 320.08058, Florida

26  Statutes, are amended to read:

27         320.08058  Specialty license plates.--

28         (19)  SEA TURTLE LICENSE PLATES.--

29         (b)  The annual use fees shall be deposited in the

30  Marine Resources Conservation Trust Fund in the Fish and

31  Wildlife Conservation Commission. The first $500,000 in annual

  1  revenue shall be used by the Florida Marine Turtle Protection

  2  Program to conduct sea turtle protection, research, and

  3  recovery programs. Additional license plate revenue, up to an

  4  amount not exceeding 30 percent of the total annual revenue,

  5  shall be dispersed annually through the marine turtle grants

  6  program as provided in s. 370.12(1)(h). The remaining annual

  7  use proceeds shall be used by the Florida Marine Turtle

  8  Protection Program for sea turtle conservation activities. The

  9  remaining annual use proceeds shall be used by the commission

10  for sea turtle conservation activities, except that up to 30

11  percent of the remaining annual use fee proceeds shall be

12  annually disbursed through the marine turtle grants program as

13  provided in s. 370.12(1)(h).

14         (31)  SHARE THE ROAD LICENSE PLATES.--

15         (b)  The annual use fees shall be distributed to Bike

16  Florida, Inc., up to 25 percent the Florida Governor's Council

17  on Physical Fitness and Amateur Sports, a portion of which

18  shall be used for marketing and promotion of the "Share the

19  Road" concept and license plate. The remaining funds shall be

20  divided equally between Bike Florida, Inc., and the Florida

21  Bicycle Association, Inc., to be used for:

22         1.  Education and awareness programs, for bicycle

23  safety and motorist safety, with emphasis on sharing the

24  roadway by all users.

25         2.  Training, workshops, educational materials, and

26  media events.

27         3.  The promotion of safe bicycling.

28         Section 3.  This act shall take effect July 1, 2000.

  1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  2                              SB 768

  4  This CS provides that certain revenue generated through the
    sale of military license plates would be deposited into the
  5  Grants and Donations Trust Fund for the benefit of the
    Veterans' Nursing Home of Florida and its residents.  This CS
  6  also revises the distribution of revenue generated through
    sales of the Sea Turtle license plate and the Share the Road
  7  license plate.
