18 Section 2. Medicare prescription discount program.--
19 (1)(a) As a condition of participation in the pharmacy
20 benefit program, a pharmacy must agree to charge any
21 individual who is a Medicare beneficiary and who is a Florida
22 resident showing a Medicare card when they present a
23 prescription a price no greater than the cost of ingredients
24 equal to the average wholesale price minus 9 percent, and a
25 dispensing fee of $4.50.
26 (b) In order for individuals to be eligible for
27 participation in this program, the Agency for Health Care
28 Administration must determine that the individuals are
29 residents of the state who are 65 years of age or older, or
30 disabled as defined in s. 415.102(10), Florida Statutes, and
31 have incomes at or below 250 percent of the federal poverty

1 level. The agency shall make the list of eligible individual
2 participants available on-line to participating pharmacies.
3 (2) In lieu of the provisions of paragraph (1)(a), as
4 a condition of participation in the pharmacy benefit program,
5 a pharmacy must agree to:
6 (a) Provide a private voluntary prescription discount
7 program to state residents who are Medicare beneficiaries; or
8 (b) Accept a private voluntary discount prescription
9 program from state residents who are Medicare beneficiaries.
10 (3) In order for a drug product to be covered under
11 this program, the product's manufacturer shall:
12 (a) Provide a rebate to the state equal to the rebate
13 required by the Medicaid program on a basis determined by the
14 agency; and
15 (b) Make the drug product available to the program for
16 the best price that the manufacturer makes the drug product
17 available under any purchasing agreement.
18 Section 3. There is hereby appropriated from the
19 General Revenue Fund to the Agency for Health Care
20 Administration for fiscal year 2000-2001 the sum of
21 $15,224,242 to fund the pharmacy benefit program established
22 under this act.
23 Section 4. There is hereby appropriated from the
24 General Revenue Fund to the Agency for Health Care
25 Administration the sum of $250,000 for implementation of the
26 Medicare prescription discount program provided for under this
27 act.
