3 amending s. 230.23, F.S.; requiring each school
4 district with a school designated as
5 performance grade category "F" to permit
6 transfer of teachers with certain
7 qualifications; providing bonuses for certain
8 teachers; authorizing the State Board of
9 Education to adopt alternative eligibility
10 criteria; requiring the Commissioner of
11 Education to adopt rules; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Paragraph (c) of subsection (16) of section
17 230.23, Florida Statutes, is amended to read:
18 230.23 Powers and duties of school board.--The school
19 board, acting as a board, shall exercise all powers and
20 perform all duties listed below:
21 (16) IMPLEMENT SCHOOL IMPROVEMENT AND
22 ACCOUNTABILITY.--Maintain a system of school improvement and
23 education accountability as provided by statute and State
24 Board of Education rule. This system of school improvement and
25 education accountability shall be consistent with, and
26 implemented through, the district's continuing system of
27 planning and budgeting required by this section and ss.
28 229.555 and 237.041. This system of school improvement and
29 education accountability shall include, but is not limited to,
30 the following:

1 (c) Assistance and intervention.--Develop a 2-year
2 plan of increasing individualized assistance and intervention
3 for each school in danger of not meeting state standards or
4 making adequate progress, as defined pursuant to statute and
5 State Board of Education rule, toward meeting the goals and
6 standards of its approved school improvement plan. A school
7 that is identified as being in performance grade category "D"
8 pursuant to s. 229.57 is in danger of failing and must be
9 provided assistance and intervention. Each school district in
10 which there is a school designated as performance grade
11 category "F" shall develop a plan to encourage teachers with
12 demonstrated mastery in improving student performance to
13 remain at or transfer to that school. If a teacher whose
14 mastery has been formally recognized by the designation of
15 Teacher of the Year at the district or state level, or who is
16 certified by the National Board of Professional Teaching
17 Standards, requests assignment to a school with grade category
18 "F," the school board and the principal shall make every
19 practical effort to grant the request. Effective July 1, 2001,
20 a teacher who has attained NBPTS certification or who has been
21 designated district or state Teacher of the Year is eligible
22 for an annual bonus of up to $1,000, as provided for annually
23 in the General Appropriations Act, each year he or she teaches
24 at a school designated as performance grade category "F." Such
25 bonus shall be in addition to any bonus received because of
26 NBPTS certification. The State Board of Education may
27 authorize alternative eligibility criteria which are based
28 upon statistical evidence which demonstrates the effectiveness
29 of the teacher based upon positive learning gains of his or
30 her students as measured by annual FCAT assessments pursuant
31 to s. 229.57. The Commissioner of Education shall adopt rules

1 to determine the measures that define "teaching mastery" for
2 purposes of this paragraph. District school boards are
3 encouraged to prioritize the expenditures of funds received
4 from specific appropriation 110A of the General Appropriations
5 Act of fiscal year 1999-2000 to improve student performance in
6 schools that receive a performance grade category designation
7 of "D" or "F."
8 Section 2. This act shall take effect July 1, 2000.

Requires each school district with a school designated as

teachers with certain qualifications. Provides bonuses
14 for teachers with certain qualifications who teach in
schools designated as performance grade category "F."
