3 s. 290.0065, F.S.; providing for a change in
4 the boundaries of an enterprise zone; providing
5 limitations; amending ss. 290.00691 and
6 290.00692, F.S.; exempting certain enterprise
7 zones in Columbia County and Suwannee County
8 from a requirement that certain areas suffer
9 from pervasive poverty, unemployment, and
10 general distress; providing that businesses
11 located in such enterprise zones may claim
12 certain tax credits for hiring persons within
13 the jurisdictions of the counties; revising
14 qualifications for businesses in such zones to
15 claim certain maximum tax exemptions or
16 credits; creating ss. 290.00694, 290.00695,
17 290.00696, and 290.00697, F.S.; authorizing the
18 Office of Tourism, Trade, and Economic
19 Development to designate enterprise zones in
20 Sarasota County or Sarasota County and the City
21 of Sarasota, Hernando County or Hernando County
22 and the City of Brooksville, Calhoun County,
23 and Holmes County; providing requirements with
24 respect to such enterprise zones; authorizing
25 certain cities to apply for expansion of
26 certain enterprise zone boundaries; providing
27 requirements; providing an effective date.

29 Be It Enacted by the Legislature of the State of Florida:

1 Section 1. Subsection (12) is added to section
2 290.0065, Florida Statutes, to read:
3 290.0065 State designation of enterprise zones.--
4 (12) Before June 1, 2001, the governing body of a
5 municipality that is located within a county having a
6 population of less than 200,000 and in which an enterprise
7 zone designated under subparagraph (3)(a)2., is located may
8 apply to the Office of Tourism, Trade, and Economic
9 Development to change the boundaries of the enterprise zone.
10 The Office of Tourism, Trade, and Economic Development shall
11 approve the application if the boundary change does not
12 increase the overall size of the enterprise zone and any
13 territory added to the enterprise zone as a result of the
14 boundary change is contiguous to the remaining area of the
15 existing enterprise zone.
16 Section 2. Section 290.00691, Florida Statutes, is
17 amended to read:
18 290.00691 Enterprise zone designation for Columbia
19 County or Columbia County and Lake City.--
20 (1) Columbia County, or Columbia County and the
21 municipality of Lake City jointly, may apply to the Office of
22 Tourism, Trade, and Economic Development for designation of
23 one enterprise zone encompassing an area within the county, or
24 within both the county and the municipality. In identifying
25 the area to be nominated for designation as an enterprise
26 zone, Columbia County, or Columbia County and the municipality
27 of Lake City jointly, shall seek to maximize the strategic
28 economic development advantages resulting from the
29 intersection of Interstate 75 and Interstate 10 within
30 Columbia County. The application must be submitted by December
31 31, 1999, and must comply with the requirements of s. 290.0055

1 except paragraph (4)(d). Notwithstanding the provisions of s.
2 290.0065 limiting the total number of enterprise zones
3 designated and the number of enterprise zones within a
4 population category, the Office of Tourism, Trade, and
5 Economic Development may designate one enterprise zone under
6 this section. The Office of Tourism, Trade, and Economic
7 Development shall establish the initial effective date of the
8 enterprise zone designated pursuant to this section.
9 (2) Notwithstanding the enterprise zone residency
10 requirements set out in ss. 212.096(1)(c) and 220.03(1)(q),
11 businesses located in an enterprise zone designated pursuant
12 to this section may receive the credit provided under s.
13 212.096 or s. 220.181 for hiring any person within the
14 jurisdiction of the county within which such enterprise zone
15 is located. All other provisions of ss. 212.096, 220.03(1)(q),
16 and 220.181 apply to such businesses. Notwithstanding the
17 requirement specified in ss. 212.08(5)(g)5., (h)5., and
18 (15)(a) and 220.182(1)(b) that no less than 20 percent of a
19 business' employees, excluding temporary and part-time
20 employees, must be residents of an enterprise zone for the
21 business to qualify for the maximum exemption or credit
22 provided in ss. 212.08(5)(g), (h), and (15) and 220.182, a
23 business that is located in an enterprise zone designated
24 pursuant to this section shall be qualified for those maximum
25 exemptions or credits if no less than 20 percent of such
26 employees of the business are residents of the jurisdiction of
27 the county within which the enterprise zone is located. All
28 other provisions of ss. 212.08(5)(g), (h), and (15) and
29 220.182 apply to such business.
30 Section 3. Section 290.00692, Florida Statutes, is
31 amended to read:

1 290.00692 Enterprise zone designation for Suwannee
2 County or Suwannee County and Live Oak.--
3 (1) Suwannee County, or Suwannee County and the
4 municipality of Live Oak jointly, may apply to the Office of
5 Tourism, Trade, and Economic Development for designation of
6 one enterprise zone encompassing an area within the county, or
7 within both the county and the municipality. In identifying
8 the area to be nominated for designation as an enterprise
9 zone, Suwannee County, or Suwannee County and the municipality
10 of Live Oak jointly, shall seek to maximize the strategic
11 economic development advantages resulting from the
12 intersection of Interstate 75 and Interstate 10. The
13 application must be submitted by December 31, 1999, and must
14 comply with the requirements of s. 290.0055 except paragraph
15 (4)(d). Notwithstanding the provisions of s. 290.0065 limiting
16 the total number of enterprise zones designated and the number
17 of enterprise zones within a population category, the Office
18 of Tourism, Trade, and Economic Development may designate one
19 enterprise zone under this section. The Office of Tourism,
20 Trade, and Economic Development shall establish the initial
21 effective date of the enterprise zone designated pursuant to
22 this section.
23 (2) Notwithstanding the enterprise zone residency
24 requirements set out in ss. 212.096(1)(c) and 220.03(1)(q),
25 businesses located in an enterprise zone designated pursuant
26 to this section may receive the credit provided under s.
27 212.096 or s. 220.181 for hiring any person within the
28 jurisdiction of the county within which such enterprise zone
29 is located. All other provisions of ss. 212.096, 220.03(1)(q),
30 and 220.181 apply to such businesses. Notwithstanding the
31 requirement specified in ss. 212.08(5)(g)5., (h)5., and

1 (15)(a) and 220.182(1)(b) that no less than 20 percent of a
2 business' employees, excluding temporary and part-time
3 employees, must be residents of an enterprise zone for the
4 business to qualify for the maximum exemption or credit
5 provided in ss. 212.08(5)(g), (h), and (15) and 220.182, a
6 business that is located in an enterprise zone designated
7 pursuant to this section shall be qualified for those maximum
8 exemptions or credits if no less than 20 percent of such
9 employees of the business are residents of the jurisdiction of
10 the county within which the enterprise zone is located. All
11 other provisions of ss. 212.08(5)(g), (h), and (15) and
12 220.182 apply to such business.
13 Section 4. Sections 290.00694, 290.00695, 290.00696,
14 and 290.00697, Florida Statutes, are created to read:
15 290.00694 Enterprise zone designation for Sarasota
16 County or Sarasota County and Sarasota.--Sarasota County, or
17 Sarasota County and the City of Sarasota jointly, may apply to
18 the Office of Tourism, Trade, and Economic Development for
19 designation of one enterprise zone within the county, or
20 within both the county and the municipality, which zone
21 encompasses an area that is south of the north county line,
22 west of Tuttle Avenue, north of 10th Street, and east of U.S.
23 Highway 41. The application must be submitted by December 31,
24 2000, and must comply with the requirements of s. 290.0055.
25 Notwithstanding the provisions of s. 290.0065 limiting the
26 total number of enterprise zones designated and the number of
27 enterprise zones within a population category, the Office of
28 Tourism, Trade, and Economic Development may designate one
29 enterprise zone under this section. The Office of Tourism,
30 Trade, and Economic Development shall establish the initial

1 effective date of the enterprise zone designated under this
2 section.
3 290.00695 Enterprise zone designation for Hernando
4 County or Hernando County and Brooksville.--Hernando County,
5 or Hernando County and the City of Brooksville jointly, may
6 apply to the Office of Tourism, Trade, and Economic
7 Development for designation of one enterprise zone within the
8 county, or within both the county and the municipality, which
9 zone encompasses an area starting north of the City of
10 Brooksville with properties within the Gregg Mine Industrial
11 Park; those lands located on the east side of Cobb Road south
12 of Yontz Road to the intersection of Jefferson Street and
13 State Road 50; lands adjacent to the State Road 50 Bypass east
14 to the intersection of Jefferson Street and State Road 50 in
15 the southeast area of the City of Brooksville; those lands
16 encompassing the areas north and south of Summit Road from
17 Hale Avenue to the west, east to Jefferson Street; lands
18 adjacent to U.S. Highway 41 from the State Road 50 Bypass
19 south to the proposed Ayers Road Extension; those lands
20 encompassing the Hernando County Airport east of U.S. Highway
21 41 west to the Suncoast Parkway with Spring Hill Drive and
22 Powell Road to the north including portions along Spring Hill
23 Drive east and west of the intersection with California
24 Street; and those lands adjacent to Anderson Snow Road and
25 Corporate Boulevard known as Holland Springs Industrial Park.
26 The application must be submitted by December 31, 2000, and
27 must comply with the requirements of s. 290.0055.
28 Notwithstanding the provisions of s. 290.0065 limiting the
29 total number of enterprise zones designated and the number of
30 enterprise zones within a population category, the Office of
31 Tourism, Trade, and Economic Development may designate one

1 enterprise zone under this section. The Office of Tourism,
2 Trade, and Economic Development shall establish the initial
3 effective date of the enterprise zone designated under this
4 section.
5 290.00696 Enterprise zone designation for Calhoun
6 County.--Calhoun County may apply to the Office of Tourism,
7 Trade, and Economic Development for designation of one
8 enterprise zone within an area in Calhoun County. The
9 application must be submitted by December 31, 2000, and must
10 comply with the requirements of s. 290.0055 except subsection
11 (3). Notwithstanding the provisions of s. 290.0065 limiting
12 the total number of enterprise zones designated and the number
13 of enterprise zones within a population category, the Office
14 of Tourism, Trade, and Economic Development may designate one
15 enterprise zone under this section. The Office of Tourism,
16 Trade, and Economic Development shall establish the initial
17 effective date of the enterprise zone designated pursuant to
18 this section.
19 290.00697 Enterprise zone designation for Holmes
20 County.--Holmes County may apply to the Office of Tourism,
21 Trade, and Economic Development for designation of one
22 enterprise zone within an area in Holmes County. The
23 application must be submitted by December 31, 2000, and must
24 comply with the requirements of s. 290.0055. Notwithstanding
25 the provisions of s. 290.0065 limiting the total number of
26 enterprise zones designated and the number of enterprise zones
27 within a population category, the Office of Tourism, Trade,
28 and Economic Development may designate one enterprise zone
29 under this section. The Office of Tourism, Trade, and Economic
30 Development shall establish the initial effective date of the
31 enterprise zone designated pursuant to this section.

1 Section 5. A city with a population of 65,000 which
2 has an eastern seaboard beachfront and a mainland with an
3 economically depressed area with a population of 45,000 and
4 has a foremost historically black college within that
5 economically depressed area, may apply to the Office of
6 Tourism, Trade, and Economic Development to expand the
7 boundaries of the enterprise zone in such area may to include
8 the following area: lands bounded by Nova Road; Mason Avenue
9 from Nova Road to Ridgewood; Ridgewood to Shady Place; and
10 Shady Place to Nova Road. The Office of Tourism, Trade, and
11 Economic Development shall approve the application if such
12 area suffers from pervasive poverty, unemployment, and general
13 distress as provided in s. 290.0058.
14 Section 6. This act shall take effect upon becoming a
15 law.
