11  Senator Laurent moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 10, between lines 3 and 4,

15

16  insert:

17         Section 4.  Subsection (5) of section 316.1935, Florida

18  Statutes, is amended, and subsection (6) is added to that

19  section, to read:

20         316.1935  Fleeing or attempting to elude a law

21  enforcement officer; aggravated fleeing and eluding.--

22         (5)(a)  The court may revoke, for a period not to

23  exceed 1 year, the driver's license of any operator of a motor

24  vehicle convicted of a violation of subsection (1).

25         (b)  The court shall revoke, for a period of not less

26  than 1 year and not more than 5 years, the driver's license of

27  any operator of a motor vehicle convicted of a violation of

28  subsection (2) or subsection (3).

29         (c)  The court shall revoke, for a period of not less

30  than 5 years and not more than 25 years, the driver's license

31  of any operator of a motor vehicle convicted of a violation of

 1  subsection (4).  The period of revocation shall begin upon

 2  release from imprisonment. The court may revoke, for a period

 3  not to exceed 1 year, the driver's license of any operator of

 4  a motor vehicle convicted of a violation of subsection (1),

 5  subsection (2), subsection (3), or subsection (4).

 6         (6)  A person whose driving privilege has been revoked

 7  under this section may petition the department for

 8  reinstatement of his or her driving privilege on a restricted

 9  basis solely for business or employment purposes as provided

10  in s. 322.271(1)(b).

20         amending s. 316.1935, F.S.; increasing

23         and eluding a law enforcement officer;

24         providing for the person whose license has been

25         revoked the right to petition for a restricted

26         license for business or employment purposes;
