11  Senator Mitchell moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 3, between lines 22 and 23,

15

16  insert:

17         Section 2.  Present paragraphs (e), (f), (g), and (h)

18  of subsection (3) of section 110.123, Florida Statutes, are

19  redesignated as paragraphs (f), (g), (h), and (i),

20  respectively, and a new paragraph (e) is added to that

21  subsection, to read:

22         110.123  State group insurance program.--

23         (3)  STATE GROUP INSURANCE PROGRAM.--

24         (e)  The Department of Management Services or the

25  Division of State Group Insurance may not prohibit or limit

26  any properly licensed insurer, health maintenance

27  organization, prepaid limited health services organization, or

28  insurance agent from competing for any insurance product or

29  plan purchased, provided, or endorsed by the department or the

30  division on the basis of the compensation arrangement used by

31  the insurer or organization for its agents.

  1         Section 3.  Subsection (3) is added to section 287.022,

  2  Florida Statutes, to read:

  3         287.022  Purchase of insurance.--

  4         (3)  The Department of Management Services or the

  5  Division of State Group Insurance may not prohibit or limit

  6  any properly licensed insurer, health maintenance

  7  organization, prepaid limited health services organization, or

  8  insurance agent from competing for any insurance product or

  9  plan purchased, provided, or endorsed by the department or the

10  division on the basis of the compensation arrangement used by

11  the insurer or organization for its agents.

18         On page 1, line 21, after the semicolon,

20  insert:

25         by the insurer or organization;
