2 An act relating to the City of Jacksonville and
3 the St. Johns River Power Park; amending
4 chapter 80-513, Laws of Florida, as amended by
5 chapter 90-439, Laws of Florida, to permit a
6 limited number of former employees of JEA who
7 go to work for the St. Johns River Power Park
8 to have the option of staying in the 1937
9 Employees' Pension Fund of the City of
10 Jacksonville or joining the St. Johns River
11 Power Park retirement plan; permitting a
12 limited number of former employees of the St.
13 Johns River Power Park who go to work for JEA
14 to have the option of staying in the St. Johns
15 River Power Park retirement plan or joining the
16 1937 Employees' Pension Fund of the City of
17 Jacksonville; providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Paragraph (1) of section 12 of chapter
22 80-513, Laws of Florida, as amended by chapter 90-439, Laws of
23 Florida, is amended to read:
24 Section 12. In order to enable JEA the authority to
25 implement and accomplish any joint electric power project with
26 respect to which JEA the authority has entered into an
27 agreement under section 2(A) of this act, JEA the authority
28 shall have the following powers, in addition to powers
29 otherwise conferred:
30 (1)(a) Employees.--To employ personnel whose duties
31 shall relate exclusively to any such joint electric power

1 project. Such employees shall not be employees of the City of
2 Jacksonville, or members of the Civil Service System of the
3 City of Jacksonville, nor shall they participate in the
4 pension fund of the city notwithstanding any provision of the
5 Charter or Ordinance Code of the City of Jacksonville to the
6 contrary except as provided in this section subsection. JEA
7 The authority may fix and pay to such employees such
8 compensation and provide to them such other employee rights
9 and benefits as it shall determine. In addition, JEA the
10 authority may allocate to the joint electric power project the
11 services of any of its other employees, whether appointed or
12 within the Civil Service System of the city, from time to time
13 on a temporary basis in order to provide necessary support or
14 assistance to the joint electric power project. Such
15 temporary assignment of any civil service employee to a
16 project shall not exceed 60 consecutive days in duration. In
17 the event that an employee of JEA the authority who is a
18 member of the classified civil service system of the city and
19 is participating in the 1937 Employees' Pension Fund of the
20 city should become a full-time employee of any such joint
21 electric power project after the effective date of this act,
22 then such employee shall no longer be a member of the city
23 civil service system and shall relinquish all rights and
24 privileges inuring to employees within said system and shall
25 thereafter be entitled only to those benefits as shall be
26 afforded other full-time employees of the joint electric power
27 project, except as provided by this section.
28 (b) Pension participation.--An However, any employee
29 who shall leave JEA employment the city civil service system
30 in order to become an employee of such a project without break
31 in service prior to January 1, 1990, may, at his or her

1 option, continue as a member of the 1937 Employees' Pension
2 Fund and upon continuation shall make the required employee
3 contribution thereto and the matching contribution which had
4 theretofor been paid into this fund by JEA the authority on
5 behalf of such employee shall thereafter be assumed and paid
6 by the project. No person who is receiving time service
7 pension payments from any pension fund of the city may become
8 an employee of a joint electric power project and continue to
9 receive payments from the fund during such period of
10 employment. However, should any such person whose pension
11 benefits have been so terminated cease his or her employment
12 with the joint electric power project, he or she shall
13 immediately become qualified for and be entitled to receive
14 those benefits he or she had previously been entitled to. Any
15 person receiving a time service pension under the 1937
16 Employees' Pension Fund of the city who becomes an employee of
17 St. Johns River Power Park may elect to join either the St.
18 Johns River Power Park retirement plan or to rejoin the 1937
19 Employees' Pension Fund but the option to rejoin the 1937
20 Employees' Pension Fund shall terminate December 31, 1990, and
21 thereafter all persons who become employed by St. Johns River
22 Power Park may participate only in the St. Johns River Power
23 Park retirement plan. Any employee who may elect to rejoin
24 the 1937 Employees' Pension Fund shall not be eligible to
25 participate in any St. Johns River Power Park retirement plan
26 including social security. The St. Johns River Power Park
27 shall make the required employer contribution into the fund
28 for such employees in the same manner and amount as JEA the
29 City of Jacksonville is required to do for JEA city employees
30 who are members of the fund. Any active employee of the St.
31 Johns River Power Park participating in the St. Johns River

1 Power Park retirement plan who, without break in service,
2 becomes an employee of JEA may, at his or her option, continue
3 as a member of the St. Johns River Power Park retirement plan
4 including social security. JEA shall make the required
5 employer contribution into the fund for such employees in the
6 same manner and amount as the St. Johns River Power Park is
7 required to do for St. Johns River Power Park employees who
8 are members of the fund. This option to remain as a member of
9 the St. Johns River Power Park retirement plan after becoming
10 an employee of JEA shall be available and limited to the first
11 150 employees exercising this option.
12 Section 2. This act is intended to provide prospective
13 rights and limitations which shall take effect upon this act
14 becoming a law.
15 Section 3. This act shall take effect upon becoming a
16 law.
