17 Section 1. Subsection (4) is added to section 39.011,
18 Florida Statutes, to read:
19 39.011 Immunity from liability.--
20 (4) RIGHTS OF CHILD PROTECTION AND CHILD WELFARE
21 WORKERS WHILE UNDER INVESTIGATION.--Whenever a child
22 protection worker or child welfare worker is under
23 investigation for any reason which could lead to disciplinary
24 action, demotion, or dismissal, resulting from alleged
25 wrongdoing in a child abuse, abandonment, or neglect case,
26 such investigation shall be conducted under the following
27 conditions:
28 (a) The child protection worker or child welfare
29 worker shall be informed of the nature of the investigation.
30 (b) The child protection worker or child welfare
31 worker shall not be threatened with transfer, dismissal, or

1 disciplinary action and shall be reassigned to another
2 nonsensitive position with pay pending the outcome of the
3 investigation.
4 (c) At the request of any child protection worker or
5 child welfare worker under investigation, he or she shall have
6 the right to be represented by counsel or any other
7 representative of his or her choice, who shall be present at
8 all times during the investigation whenever the investigation
9 relates to the worker's continued fitness for public service.
10 (d) If the child protection worker or child welfare
11 worker under investigation is under arrest, or is likely to be
12 placed under arrest as a result of the investigation, he or
13 she shall be completely informed of all his or her rights
14 prior to the commencement of the investigation.
