5 County; codifying the District charter, chapter
6 77-535, Laws of Florida, as amended, pursuant
7 to section 191.015, Florida Statutes; providing
8 legislative intent; amending, codifying, and
9 reenacting all special acts relating to Big
10 Corkscrew Island Fire Control and Rescue
11 District as a single act; repealing all prior
12 special acts relating to Big Corkscrew Island
13 Fire Control and Rescue District; providing an
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Pursuant to section 191.015, Florida
19 Statutes, this act constitutes the codification of all special
20 acts relating to Big Corkscrew Island Fire Control and Rescue
21 District. It is the intent of the Legislature in enacting this
22 law to provide a single, comprehensive special act charter for
23 the District including all current legislative authority
24 granted to the District by its several legislative enactments
25 and any additional authority granted by this act. It is
26 further the intent of this act to preserve all District
27 authority, including the authority to annually assess and levy
28 against the taxable property in the District a tax not to
29 exceed 2.0 mills on the dollar of assessed valuation, except
30 as provided in chapter 191, Florida Statutes, as amended from
31 time to time.

1 Section 2. Chapter 77-535, Laws of Florida, as
2 amended, is amended, codified, reenacted, and repealed as
3 herein provided.
4 Section 3. The Big Corkscrew Island Fire Control and
5 Rescue District is re-created and the charter for such
6 District is re-created and reenacted to read:
7 Section 1. Creation.--All that area of land located in
8 Collier County, Florida, described as:
9
10 Range 27 East, Township 47 South; Range 28
11 East, Township 47 South; Range 27 East, except
12 Sections 29, 30, 31, and 32, Township 48 South;
13 Range 28 East, Township 48 South; Range 29
14 East, except Sections 1, 2, 3, 4, 5, 6, 7, 8,
15 9, 10, 11, 12, 13, 14, 15, 16, 17, and 18,
16 Township 48 South; Range 28 East, except
17 Sections 4, 5, 6, 7, 8, 9, 16, 17, 18, 19, 20,
18 21, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35,
19 and 36, Township 49 South; Range 29 East,
20 except Sections 25, 26, 27, 28, 29, 30, 31, 32,
21 33, 34, 35, and 36, Township 49 South; all of
22 said lands being located in Collier County as
23 set forth in the public records,

25 is hereby created and established as an independent fire
26 control and rescue district known as the Big Corkscrew Island
27 Fire Control and Rescue District. The District's geographic
28 boundary shall be as set forth in this act.
29 Section 2. Status and purpose.--The Big Corkscrew
30 Island Fire Control and Rescue District, an independent

1 special district, is organized and exists for all purposes set
2 forth in this act and chapters 189 and 191, Florida Statutes.
3 Section 3. Creation; amendment of charter.--The
4 District was created by special act of the Legislature in
5 1977. Its charter may be amended only by special act of the
6 Legislature.
7 Section 4. Governing body.--There shall be a District
8 board to consist of three members who are residents of the
9 District who shall constitute the Big Corkscrew Island Fire
10 Control and Rescue District, to be elected as provided in
11 chapter 191, Florida Statutes, as it may be amended from time
12 to time.
13 Section 5. Officers.--Within 60 days after the
14 election and qualification of its members, the board shall
15 meet and elect from its membership a president, a secretary,
16 and a treasurer, or a secretary-treasurer. The District shall
17 have and the board may exercise all the general and special
18 powers and duties prescribed in this act and chapters 189 and
19 191, Florida Statutes, as they may be amended from time to
20 time.
21 Section 6. Policies and regulations.--The board is
22 authorized to adopt policies and regulations for the
23 prevention of fire and for fire control in the District, which
24 policies and regulations shall have the same force and effect
25 as law 10 days after copies thereof executed by the president
26 and secretary of the board have been posted in at least two
27 public places.
28 Section 7. Budget.--For the purposes of carrying into
29 effect this act, the board shall annually prepare, consider,
30 and adopt a District budget pursuant to the applicable

1 requirements of chapter 200, Florida Statutes, as it may be
2 amended from time to time.
3 Section 8. Taxing authority.--The District board shall
4 fix and cause to be levied on all property of said District,
5 real and personal, a millage sufficient to meet the
6 requirements of the adopted budget, provided the total millage
7 shall not exceed 2.0 mills except as provided by chapter 191,
8 Florida Statutes.
9 Section 9. Powers and duties.--
10 (1) The District shall hold all powers, functions, and
11 duties set forth in chapters 189 and 191, Florida Statutes, as
12 they may be amended from time to time, regarding ad valorem
13 taxation, bond issuance, other revenue-raising capabilities,
14 budget preparation and approval, liens and foreclosure of
15 liens, use of tax deeds and tax certificates as appropriate
16 for non-ad valorem assessments, and contractual agreements.
17 The District may be financed by any method established in this
18 act, chapter 189 or chapter 191, Florida Statutes, or any
19 other applicable general or special law, as any of these may
20 be amended from time to time.
21 (2) The methods for assessing and collecting non-ad
22 valorem assessments, fees, or service charges shall be as set
23 forth in chapter 170, chapter 189, chapter 191, or chapter
24 197, Florida Statutes, as any of these may be amended from
25 time to time.
26 (3) Requirements for financial disclosure, meeting
27 notices, reporting, public records maintenance, and per diem
28 expenses for officers and employees shall be as set forth in
29 chapters 112, 119, 189, 191, and 286, Florida Statutes, as
30 they may be amended from time to time.

1 (4) The District's planning requirements shall be as
2 set forth in this act and chapters 189 and 191, Florida
3 Statutes, as they may be amended from time to time.
4 Section 4. If any clause, section, or provision of
5 this act is declared unconstitutional or invalid for any cause
6 or reason, it shall be eliminated from this act, and the
7 remaining portion of this act shall remain in force and effect
8 as if said unconstitutional or invalid portion had not been
9 incorporated therein.
10 Section 5. This act shall be construed as a remedial
11 act and shall be liberally construed to promote the purpose
12 for which it is intended.
13 Section 6. Chapters 77-535, 80-487, 85-401, 85-402,
14 87-512, 89-453, 90-444, 91-336, and 98-493, Laws of Florida,
15 are repealed.
16 Section 7. This act shall take effect upon becoming a
17 law.
