17         (c)  The penalties provided in this act shall not apply

18  to any person or juvenile detained, incarcerated or committed

19  to a facility who has mental retardation as the term

20  "retardation" is defined in section 393.063(44), Florida

21  Statutes, or has a "mental illness" as defined in section

22  394.455(18), Florida Statutes.
