4 certain business records used by entertainment
5 industry production companies; providing an
6 expiration date; providing a finding of public
7 necessity; providing a contingent effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Business records provided by an
13 entertainment industry production company to the Office of the
14 Film Commissioner in order to receive sales and use tax
15 exemptions under sections 212.031, 212.06, and 212.08, Florida
16 Statutes, in accordance with section 288.1258, Florida
17 Statutes, are confidential and exempt from the disclosure
18 provisions of section 24(a) of Article I of the State
19 Constitution and section 119.07(1), Florida Statutes. This
20 exemption is subject to the Open Government Sunset Review Act
21 in accordance with section 119.15, Florida Statutes, and
22 expires on October 2, 2005, unless reviewed and reenacted by
23 the Legislature.
24 Section 2. The Legislature finds that it is a public
25 necessity that business records provided by an entertainment
26 industry production company to the Office of the Film
27 Commissioner in order to receive sales and use tax exemptions
28 be held confidential in order to encourage the expansion of
29 the industry in the state through investment and job creation.
30 Furthermore, the Legislature finds that it would be an

1 invasion of privacy for these sensitive business records to be
2 revealed to the public.
3 Section 3. This act shall take effect on the effective
4 date of SB or similar legislation, relating to tax
5 exemptions for entertainment industry production companies,
6 and shall not take effect if that legislation does not become
7 a law.
