  1                      A bill to be entitled

  2         An act relating to the Save Our Everglades

  3         Trust Fund; creating s. 375.047, F.S.; creating

  4         the Save Our Everglades Trust Fund; providing

  5         for its purposes; providing for review and

  6         termination or re-creation of the trust fund;

  7         providing a contingent effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 375.047, Florida Statutes, is

12  created to read:

13         375.047  Save Our Everglades Trust Fund.--

14         (1)  There is created the Save Our Everglades Trust

15  Fund to be administered by the Department of Environmental

16  Protection. Funds provided pursuant to s. 259.201(4)(a) and

17  (b) for the Save Our Everglades Act shall be deposited into

18  this trust fund. Other funds from grants and donations,

19  federal funds, or other funds from other sources specified by

20  law may be deposited into this fund and used for purposes of

21  the Save Our Everglades Act.

22         (2)  Moneys deposited in this fund shall be spent only

23  on the following types of activities:

24         (a)  Projects that are joint federal-state partnerships

25  with project plans reflecting cost-share with federal or local

26  governments.

27         (b)  Projects to restore natural water flows, retain

28  seasonal flows, release impounded water, or improve a system's

29  ability to remove nutrients and sediments.

30         (c)  Projects that restore freshwater flows to major

31  estuarine systems including Florida Bay and Biscayne Bay.

  1         (d)  Projects that have a goal of restoring native

  2  plant and animal communities.

  3         (e)  Projects that meet one or more of the provisions

  4  of s. 11(e), Art. VII of the State Constitution.

  5         Section 2.  In accordance with Section 19(f)(2),

  6  Article III of the State Constitution, the Save Our Everglades

  7  Trust Fund shall, unless terminated sooner, be terminated on

  8  July 1, 2005. Before its scheduled termination, the trust fund

  9  shall be reviewed as provided in section 215.3206(1) and (2),

10  Florida Statutes.

11         Section 3.  This act shall take effect on the effective

12  date of Senate Bill     , but it shall not take effect unless

13  it is enacted by a three-fifths vote of the membership of each

14  house of the Legislature and unless SB     , 2000 Regular

15  Session, becomes a law.
