1 A bill to be entitled
2 An act relating to the sale of handguns;
3 amending s. 790.0655, F.S.; providing that the
4 waiting period required between the purchase
5 and delivery of a handgun does not apply to a
6 handgun sold to a law enforcement officer or
7 correctional officer; providing an effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 790.0655, Florida Statutes, is
13 amended to read:
14 790.0655 Purchase and delivery of handguns; mandatory
15 waiting period; exceptions; penalties.--
16 (1)(a) There shall be a mandatory 3-day waiting
17 period, which shall be 3 days, excluding weekends and legal
18 holidays, between the purchase and the delivery at retail of
19 any handgun. "Purchase" means the transfer of money or other
20 valuable consideration to the retailer. "Handgun" means a
21 firearm capable of being carried and used by one hand, such as
22 a pistol or revolver. "Retailer" means and includes every
23 person engaged in the business of making sales at retail or
24 for distribution, or use, or consumption, or storage to be
25 used or consumed in this state, as defined in s. 212.02(13).
26 (b) Records of handgun sales must be available for
27 inspection by any law enforcement agency, as defined in s.
28 934.02, during normal business hours.
29 (2) The 3-day waiting period shall not apply in the
30 following circumstances:
31 (a) When a handgun is being purchased by:

1 1. A holder of a concealed weapons permit as defined
2 in s. 790.06.
3 2. A law enforcement officer or correctional officer,
4 as defined in s. 943.10.
5 (b) To a trade-in of another handgun.
6 (3) It is a felony of the third degree, punishable as
7 provided in s. 775.082, s. 775.083, or s. 775.084:
8 (a) For any retailer, or any employee or agent of a
9 retailer, to deliver a handgun before the expiration of the
10 3-day waiting period, subject to the exceptions provided in
11 subsection (2).
12 (b) For a purchaser to obtain delivery of a handgun by
13 fraud, false pretense, or false representation.
14 Section 2. This act shall take effect July 1, 2000.
