2 An act relating to solid and hazardous waste
3 management; directing the Department of
4 Environmental Protection to include in its
5 annual legislative budget request funding for
6 the Southern Waste Information Exchange, Inc.,
7 to operate and maintain a waste exchange;
8 amending s. 403.703, F.S.; redefining the term
9 "storage" and defining the term "hazardous
10 waste transfer facility"; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. The Legislature recognizes the need for
16 statewide solid and hazardous waste management assistance to
17 Florida's private businesses, industries, and the public
18 sector, including local units of government. In order to
19 assist the Department of Environmental Protection in providing
20 solid and hazardous waste management assistance to Florida's
21 public and private sectors on a continuing basis, the
22 Legislature recognizes the need for a waste exchange as part
23 of the state's comprehensive solid waste and hazardous waste
24 management programs and designates Southern Waste Information
25 Exchange, Inc., a nonprofit Florida organization with
26 tax-exempt status under s. 501(c)(3) of the Internal Revenue
27 Code, to provide this service to Florida's private and public
28 sectors. The Department of Environmental Protection shall
29 include in its annual legislative budget request pursuant to
30 s. 216.023, Florida Statutes, funding for the Southern Waste
31 Information Exchange, Inc. The amount of the funding to be

1 included in the legislative budget request shall be based on
2 the department's evaluation of the total funding demands of
3 the Solid Waste Management Trust Fund and of the funding needs
4 requested by the Southern Waste Information Exchange, Inc., to
5 operate, maintain, and expand a waste exchange service and
6 similar related services as requested by the private sector
7 and local governments.
8 Section 2. Subsection (26) of section 403.703, Florida
9 Statutes, is amended and subsection (45) is added to said
10 section, to read:
11 403.703 Definitions.--As used in this act, unless the
12 context clearly indicates otherwise, the term:
13 (26) "Storage" means the containment or holding of a
14 hazardous waste, either on a temporary basis or for a period
15 of years, in such a manner as not to constitute disposal of
16 such hazardous waste. For the purposes of this chapter,
17 references to the terms "storage" and "storage facilities"
18 include management or storage of hazardous waste at hazardous
19 waste transfer facilities.
20 (45) "Hazardous waste transfer facility" means any
21 transportation-related storage facility, including loading
22 docks, parking areas, storage areas, and other similar areas
23 where manifested shipments of hazardous waste are stored or
24 held for a period of more than 24 hours but not more than 10
25 days.
26 Section 3. This act shall take effect July 1, 2000.
