1 A bill to be entitled
2 An act relating to prescription drugs for
3 Medicare participants; creating a program to
4 provide prescription drug coverage to Medicare
5 participants; providing requirements; requiring
6 discount prescription pricing for Medicare
7 beneficiaries not otherwise covered under this
8 program; requiring the Department of Elderly
9 Affairs and the Agency for Health Care
10 Administration to develop the program;
11 providing that the program is not an
12 entitlement; providing an appropriation;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Prescription Drug Program for Medicare
18 Participants.--
19 (1) There is created the Prescription Drug Program for
20 Medicare Participants to provide prescription drug coverage to
21 Medicare participants who do not otherwise have access to such
22 coverage. The program must include: an income-means test, the
23 use of copayments and deductibles, a private benefits manager,
24 and the requirement that all pharmacies, including, but not
25 limited to, independent pharmacies, may participate in the
26 program.
27 (2) The program must also provide for discount
28 prescription pricing for all Medicare beneficiaries who are
29 not otherwise covered under the prescription drug program
30 created under this section.

1 (3) The Department of Elderly Affairs and the Agency
2 for Health Care Administration shall develop this program, in
3 accordance with this section, to assist persons with
4 prescription drug costs.
5 (4) This program is not an entitlement; the state will
6 provide assistance to the extent that appropriated funds are
7 available and subject to the determination of the
8 administering agency, in accordance with the criteria
9 established under this section.
10 Section 2. There is appropriated from the General
11 Revenue Fund to the Agency for Health Care Administration for
12 fiscal year 2000-2001 $ to be used in implementing the
13 Prescription Drug Program for Medicare Participants that is
14 created in section 1 of this act.
15 Section 3. This act shall take effect July 1, 2000.
