11  Senator Hargrett moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 15, lines 18 through 26, delete those lines,

15

16  and insert:

17         Section 10.  Section 838.30, Florida Statutes, is

18  created to read:

19         838.30  Attorney's fees.--If a public servant is

20  arrested or prosecuted for any alleged violation of this

21  chapter and either the criminal charges are dismissed or the

22  public servant is acquitted, the public servant may petition

23  the employing public agency to award attorney's fees for the

24  cost of defending against those charges. The employing public

25  agency shall award attorney's fees to the public servant upon

26  a finding that the public servant's actions arose out of or in

27  connection with the performance of his or her official duties

28  and served a public purpose.
