  1                      A bill to be entitled

  2         An act relating to insurance agent continuing

  3         education requirements; amending s. 626.2815,

  4         F.S.; providing an exception to certain

  5         monitored examination requirements under

  6         certain circumstances; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Paragraph (j) of subsection (4) of section

12  626.2815, Florida Statutes, is amended to read:

13         626.2815  Continuing education required; application;

14  exceptions; requirements; penalties.--

15         (4)  The following courses may be completed in order to

16  meet the continuing education course requirements:

17         (j)  Any course, including courses relating to agency

18  management or errors and omissions, developed or sponsored by

19  any authorized insurer or recognized agents' association or

20  insurance trade association or any independent study program

21  of instruction, subject to approval by the department,

22  qualifies for the equivalency of the number of classroom hours

23  assigned thereto by the department.  However, unless otherwise

24  provided in this section, continuing education hours may not

25  be credited toward meeting the requirements of this section

26  unless the course is provided by classroom instruction or

27  results in a monitored examination. If the independent study

28  program of instruction is presented through interactive,

29  on-line technology that, to the satisfaction of the Department

30  of Insurance, has sufficient internal testing to validate the

  1  student's full comprehension of the materials presented, the

  2  requirement of a monitored examination shall be waived.

  3         Section 2.  This act shall take effect July 1, 2000.
