  1                      A bill to be entitled

  2         An act relating to golf carts; amending s.

  3         316.212, F.S.; prohibiting a person under a

  4         specified age from operating a golf cart on a

  5         public road or bike path unless that person is

  6         accompanied by an adult who is a licensed

  7         operator; providing penalties; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Present subsection (6) of section 316.212,

13  Florida Statutes, is renumbered as subsection (7) and amended,

14  and a new subsection (6) is added to that section, to read:

15         316.212  Operation of golf carts on certain

16  roadways.--The operation of a golf cart upon the public roads

17  or streets of this state is prohibited except as provided

18  herein:

19         (6)  Notwithstanding any other provision of law, a

20  person under the age of 16 years may not operate a golf cart

21  on a public road or street or bike path in this state unless

22  that person is accompanied on the golf cart by a person 18

23  years of age or older, who possesses a valid driver's license.

24         (7)(6)  A violation of this section is a noncriminal

25  traffic infraction, punishable pursuant to chapter 318 as

26  either a moving violation for infractions of subsection (1),

27  subsection (2), subsection (3), or subsection (4), or

28  subsection (6) or as a nonmoving violation for infractions of

29  subsection (5).

30         Section 2.  This act shall take effect July 1, 2000.

  3    Prohibits a person under the age of 16 years from
      operating a golf cart on a public road or bike path
  4    unless that person is accompanied on the golf cart by a
      person at least 18 years of age who possesses a valid
  5    driver's license. Makes violation punishable as a moving
      noncriminal traffic infraction.
