14         Amendment (with title amendment) 

15         On page 35, between lines 20 and 21 of the bill

16

17  insert:

18         Section 19.  Section 924.396, Florida Statutes is

19  created to read:

20         924.396 Survivor(s) of a victim of

21  homicide.--Compensation

22         (1)  For purposes of this section, survivor(s) of a

23  victim of homicide means surviving spouse or next of kin of

24  homicide victim if that person is not the defendant or in

25  custody for an offense.

26         (2)  Survivor(s) of a victim of homicide shall be

27  reimbursed, for per diem and travel expenses relating to all

28  court proceedings pursuant to s. 960.001, F.S., from the

29  Crimes Compensation Trust Fund pursuant to s. 960.21, F.S., in

30  accordance with the provisions of s. 112.061,F.S.

31         (3)  Survivor(s) of a victim of homicide shall be

 1  offered treatment for crisis intervention services including,

 2  psychiatric, psychological, bereavement or other mental health

 3  counseling services which became necessary as a direct result

 4  of the crime.  All bills related to such services shall be

 5  paid directly to affected service providers from the Crimes

 6  Compensation Trust Fund pursuant to s. 960.21, F.S.  Payment

 7  made to a service provider will be considered payment in full

 8  for the services rendered to the survivor(s) by said provider.

 9  In the event a provider does not accept the payment as payment

10  in full, then that payment may be made to the survivor(s).

11  Such compensation shall be made regardless of whether or not

12  the survivor(s) is or are covered by health or disability

13  insurance.
