16  remove from the bill:  all of said lines

18  and insert in lieu thereof:  have the defendant examined by an

19  expert of its choosing. If the defendant refuses to cooperate

20  with the state's expert, the trial court may consider the

21  defendant's refusal to cooperate in deciding the merits of the

22  defendant's mental status claims.
