14         On page 2, lines 4-27

15  remove from the bill:  all of said lines

17  and insert in lieu thereof:

18         (1)  A death sentence shall be executed by lethal

19  injection, unless the person sentenced to death affirmatively

20  selects to be executed by electrocution. The sentence shall be

21  executed under the direction of the Secretary of Corrections

22  or the secretary's designee pursuant to s. 922.10.

23         (2)  A person convicted and sentenced to death for a

24  capital crime at any time shall have one opportunity to select

25  that his or her death sentence be executed by electrocution.

26  The selection for death by electrocution is waived unless it

27  is personally made by the person in writing and delivered to

28  the warden of the correctional facility within 30 days after

29  the issuance of mandate pursuant to a decision by the State

30  Supreme Court affirming the sentence of death or, if mandate

31  issued before the effective date of this act, the selection

 1  must be made and delivered to the warden within 30 days after

 2  the effective date of this act. If a warrant of execution is

 3  pending on the effective date of this act, or if a warrant is

 4  issued within 30 days after the effective date of this act,

 5  the person sentenced to death who is the subject of the

 6  warrant shall have waived selection of electrocution as the

 7  method of execution unless a written selection signed by the

 8  person is submitted to the warden of the correctional facility

 9  no later than 48 hours after a new date for execution of the

10  death sentence is set by the Governor under s. 922.06.
