  1                      A bill to be entitled

  2         An act relating to weapons and firearms;

  3         creating s. 790.146, F.S.; providing penalties

  4         for the possession of a firearm or destructive

  5         device within the premises of a health care

  6         provider; providing exceptions; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 790.146, Florida Statutes, is

12  created to read:

13         790.146  Crimes in health care facilities; possession

14  of weapons; penalties.--

15         (1)  Unless otherwise provided by law, any person who

16  is willfully in possession of a concealed firearm, as defined

17  in s. 790.001(6), or a destructive device, as defined in s.

18  790.001(4), within the premises of a health care provider, as

19  defined in s. 408.7056(1)(d), commits a felony of the third

20  degree, punishable as provided in s. 775.082, s. 775.083, or

21  s. 775.084.

22         (2)  The provisions of this section do not apply:

23         (a)  To any law enforcement officer;

24         (b)  To any person employed and authorized by the

25  owner, operator, or manager of a health care provider to carry

26  a firearm or destructive device on such premises; or

27         (c)  To any person licensed to carry a concealed

28  weapon.

29         Section 2.  This act shall take effect July 1, 2001.
