  1                      A bill to be entitled

  2         An act relating to road rage; amending s.

  3         316.650, F.S.; providing that traffic

  4         enforcement officers must issue a copy of the

  5         traffic school reference guide with traffic

  6         citations; amending s. 318.1451, F.S.;

  7         providing that the traffic school reference

  8         guide must contain certain information;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Subsection (3) of section 316.650, Florida

14  Statutes, is amended to read:

15         316.650  Traffic citations.--

16         (3)  Every traffic enforcement officer, upon issuing a

17  traffic citation to an alleged violator of any provision of

18  the motor vehicle laws of this state or of any traffic

19  ordinance of any city or town, shall issue a copy of the

20  traffic school reference guide under the provisions of s.

21  318.1451(5) and shall deposit the original citation and one

22  copy of such traffic citation or, in the case of a traffic

23  enforcement agency which has an automated citation issuance

24  system, shall provide an electronic facsimile with a court

25  having jurisdiction over the alleged offense or with its

26  traffic violations bureau within 5 days after issuance to the

27  violator.

28         Section 2.  Paragraph (a) of subsection (5) of section

29  318.1451, Florida Statutes, is amended to read:

30         318.1451  Driver improvement schools.--

  1         (5)(a)  No governmental entity or court shall provide,

  2  issue, or maintain any information or orders regarding driver

  3  improvement schools or course providers, with the exception of

  4  directing inquiries or requests to the local telephone

  5  directory heading of driving instruction or the traffic school

  6  reference guide. The traffic school reference guide shall

  7  include a listing of course providers, including a single

  8  mailing address and a single telephone number for each course

  9  provider. However, the department is authorized to maintain

10  the information and records necessary to administer its duties

11  and responsibilities for driver improvement courses. Where

12  such information is a public record as defined in chapter 119,

13  it shall be made available to the public upon request pursuant

14  to s. 119.07(1).

15         Section 3.  This act shall take effect July 1, 2001.

      Provides that traffic enforcement officers who issue
20    citations must also issue a copy of the traffic school
      reference guide with the citation. Provides that the
21    traffic school reference guide must contain a listing of
      course providers including a single mailing address and a
22    single telephone number for each course provider.
