1 A bill to be entitled
2 An act relating to sewer and water systems and
3 stormwater systems; providing for
4 administration of a grant program by the
5 Department of Environmental Protection to
6 establish or upgrade sewer and water systems
7 and stormwater systems; providing priority of
8 projects to be funded; requiring an annual
9 report; providing for future repeal; providing
10 an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Grants for sewer and water facilities and
15 stormwater systems.--
16 (1) Notwithstanding any other provision of law, and to
17 the fullest extent possible, the Department of Environmental
18 Protection shall administer grant programs and other
19 authorized disbursements of funds for the purpose of
20 establishing or upgrading sewer and water systems and
21 stormwater systems according to the following priorities:
22 (a) Projects in communities with a millage rate of 8.5
23 mills or higher that are under a consent order from the
24 department for inadequate sewer and water facilities or
25 stormwater systems.
26 (b) Projects in communities with a millage rate of 8.5
27 mills or higher that are under a moratorium from the
28 department that inhibits the development of adequate housing
29 for community residents or other economic development
30 activities.

1 (2) Fifty percent of funds remaining after the
2 criteria in paragraphs (1)(a) and (b) have been met shall be
3 utilized for projects in communities in rural areas of
4 critical economic concern.
5 (3) The department shall report each January 1 to the
6 Governor, the President of the Senate, and the Speaker of the
7 House of Representatives regarding the amount of funding
8 disbursed for the projects in the categories identified in
9 paragraphs (1)(a) and (b) and the number and identity of
10 projects remaining in those categories. The department shall
11 also report on the amount of funding disbursed in the category
12 identified in subsection (2).
13 (4) This section shall stand repealed on June 30,
14 2006.
15 Section 2. This act shall take effect July 1, 2001.

Directs the Department of Environmental Protection to
20 administer a grant program to establish or upgrade sewer
and water systems and stormwater systems in communities
21 that meet specified criteria. Provides priority of
projects to be funded. Requires the department to report
22 annually to the Governor and Legislature on funding
disbursed and projects remaining. Terminates the program
23 on June 30, 2006.
