14 On page 1, between lines 16 and 17, of the amendment
15
16 insert:
17 Section 1. Paragraph (b) of subsection (3) of section
18 255.25, Florida Statutes, is amended to read:
19 255.25 Approval required prior to construction or
20 lease of buildings.--

22 (b) The Department of Management Services may approve
23 extensions of an existing lease of 5,000 square feet or more
24 of space if such extensions are determined to be in the best
25 interests of the state, but in no case shall the total of such
26 extensions exceed 11 months. If at the end of the 11th month
27 an agency still needs that space, it shall be procured by
28 competitive bid in accordance with s. 255.249(4)(b)(2)(b).
29 However, an agency that determines that it is in its best
30 interest to remain in the space it currently occupies may
31 negotiate a replacement lease with the lessor if an

1 independent comparative market analysis demonstrates that the
2 rates offered are within market rates for the space and the
3 cost of the new lease does not exceed the cost of a comparable
4 lease plus documented moving costs. A present-value analysis
5 and the consumer price index shall be used in the calculation
6 of lease costs. The term of the replacement lease may not
7 exceed the base term of the expiring lease.

14 insert:
15 amending s. 255.25, F.S.; authorizing state
16 agencies to execute certain replacement leases;
17 providing guidelines for the execution of such
18 leases;
