17 Section 1. Paragraph (e) is added to subsection (2) of
18 section 333.03, Florida Statutes, to read:
19 333.03 Power to adopt airport zoning regulations.--
20 (2) In the manner provided in subsection (1), interim
21 airport land use compatibility zoning regulations shall be
22 adopted. When political subdivisions have adopted land
23 development regulations in accordance with the provisions of
24 chapter 163 which address the use of land in the manner
25 consistent with the provisions herein, adoption of airport
26 land use compatibility regulations pursuant to this subsection
27 shall not be required. Interim airport land use compatibility
28 zoning regulations shall consider the following:
29 (e) Where an airport authority or other governing body
30 operating a publicly owned public-use airport has conducted a
31 noise study in accordance with the provisions of 14 C.F.R.

1 part 150, any county or municipality applying a noise exposure
2 map to a development as defined in s. 163.3164(6) pursuant to
3 its comprehensive plan, a development order, or a development
4 permit, as defined in s. 163.3164(4), (7), and (8),
5 respectively, or any land development regulation as defined in
6 s. 163.3221(7), shall utilize the noise exposure map most
7 recently approved by the Federal Aviation Administration.

14 insert:
15 amending s. 333.03, F.S.; requiring an airport
16 authority or other governing body operating a
