  1                      A bill to be entitled

  2         An act relating to workers' compensation;

  3         amending s. 440.092, F.S.; characterizing

  4         certain activities of certain officers as

  5         arising out of and in the course of employment

  6         for compensability purposes; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (2) of section 440.092, Florida

12  Statutes, is amended to read:

13         440.092  Special requirements for compensability;

14  deviation from employment; subsequent intervening accidents.--

15         (2)  GOING OR COMING.--An injury suffered while going

16  to or coming from work is not an injury arising out of and in

17  the course of employment whether or not the employer provided

18  transportation if such means of transportation was available

19  for the exclusive personal use by the employee, unless the

20  employee was engaged in a special errand or mission for the

21  employer. For purposes of this subsection, an officer, as

22  defined in s. 943.10(1), (2), or (3), who, while going to or

23  coming from work during an assigned work schedule, travels in

24  a marked or unmarked official law enforcement vehicle, shall

25  be deemed to be engaged in a special errand or mission for the

26  respective employer.

27         Section 2.  This act shall take effect upon becoming a

28  law.

      Makes a law enforcement officer's, correctional
  4    officer's, or correctional probation officer's going to
      or coming from work or traveling during an assigned work
  5    schedule in a marked or unmarked official law enforcement
      vehicle engaging in a special errand or mission for the
  6    respective employer for purposes of compensability under
      workers' compensation for injuries arising out of and in
  7    the course of employment.
