  1                      A bill to be entitled

  2         An act relating to a public-records exemption

  3         for certain information relating to prepayment

  4         of electronic-toll-facility charges by check,

  5         credit card, or charge card; amending s.

  6         338.155(6), F.S., which provides an exemption

  7         from public-records requirements for personal

  8         identifying information given to specified

  9         entities for the purpose of prepaying

10         electronic-toll-facility charges; abrogating

11         the repeal thereof scheduled under the Open

12         Government Sunset Review Act of 1995; providing

13         an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

17         Section 1.  Subsection (6) of section 338.155, Florida

18  Statutes, is amended to read:

19         338.155  Payment of toll on toll facilities required;

20  exemptions.--

21         (6)  Personal identifying information provided to,

22  acquired by, or in the possession of the Department of

23  Transportation, a county, or an expressway authority for the

24  purpose of using a credit card, charge card, or check for the

25  prepayment of electronic toll facilities charges to the

26  department, a county, or an expressway authority is exempt

27  from s. 119.07 and s. 24(a), Art. I of the State Constitution.

28  The exemption is subject to the Open Government Sunset Review

29  Act of 1995 in accordance with s. 119.15. The exemption in

30  this section shall stand repealed effective October 2, 2001,

31  unless otherwise reviewed and reenacted by the Legislature.

  1         Section 2.  This act shall take effect October 1, 2001.
