1 A bill to be entitled
2 An act relating to public-records exemption for
3 certain information relating to airport
4 security plans; amending s. 331.22, F.S., which
5 provides an exemption from public-records
6 requirements for certain information relating
7 to airport security plans; abrogating the
8 repeal of such exemption scheduled under the
9 Open Government Sunset Review Act of 1995;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 331.22, Florida Statutes, is
15 amended to read:
16 331.22 Certain information exempt from
17 disclosure.--Airport security plans of an aviation authority
18 created by act of the Legislature or of an aviation department
19 of a county or municipality which operates an international
20 airport are exempt from provisions of s. 119.07(1) and s.
21 24(a), Art. I of the State Constitution. In addition,
22 photographs, maps, blueprints, drawings, and similar materials
23 that depict critical airport operating facilities are exempt
24 from the provisions of s. 119.07(1) and s. 24(a), Art. I of
25 the State Constitution, to the extent that an aviation
26 authority created by act of the Legislature or an aviation
27 department of a county or municipality which operates an
28 airport reasonably determines that such items contain
29 information that is not generally known and that could
30 jeopardize the security of the airport; however, information
31 relating to real estate leases, layout plans, blueprints, or

1 information relevant thereto, is not to be included in this
2 exemption. The exemptions in this section are applicable only
3 to records held by an aviation authority created by act of the
4 Legislature or to records of a county or municipal aviation
5 department that operates an airport. The exemptions contained
6 in this section are subject to the Open Government Sunset
7 Review Act of 1995, in accordance with s. 119.15, and this
8 section shall stand repealed on October 2, 2001, unless
9 reviewed and saved from repeal through reenactment by the
10 Legislature.
11 Section 2. This act shall take effect October 1, 2001.
