1 A bill to be entitled
2 An act relating to uniform traffic citations;
3 requiring that the Department of Highway Safety
4 and Motor Vehicles revise the uniform traffic
5 citation; requiring a law enforcement officer
6 to indicate on the citation if a traffic
7 violation or traffic accident was caused by
8 aggressive driving; defining the term
9 "aggressive driving" for purposes of the act;
10 requiring the department to report to the
11 Legislature on the number of recorded incidents
12 of aggressive driving in the state during a
13 specified period; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. (1) The Department of Highway Safety and
18 Motor Vehicles shall revise the form of the uniform traffic
19 citation so that the form remains consistent with the Florida
20 Traffic Court rules but includes a box that shall be checked
21 by a law enforcement officer when the officer believes that a
22 traffic violation or traffic accident for which the officer
23 issues a citation was caused by aggressive driving. As used in
24 this section, the term "aggressive driving" means:
25 (a) Exceeding the lawful or posted speed by more than
26 15 miles per hour.
27 (b) Unsafely or improperly changing lanes, as defined
28 in section 316.085, Florida Statutes.
29 (c) Following another vehicle too closely, as defined
30 in section 316.0895, Florida Statutes.

1 (d) Failing to yield the right-of-way, as defined in
2 section 316.079, section 316.0815, or section 316.123, Florida
3 Statutes.
4 (e) Improperly passing, as defined in section 316.083
5 or section 316.085, Florida Statutes.
6 (f) Failing to obey a traffic-control device, as
7 defined in section 316.074 or section 316.075, Florida
8 Statutes.
9 (2) The Department of Highway Safety and Motor
10 Vehicles shall submit a report to the President of the Senate
11 and the Speaker of the House of Representatives by February 1,
12 2002, which sets forth the number of incidents of aggressive
13 driving in this state during the preceding 6-month period.
14 Section 2. This act shall take effect upon becoming a
15 law.

18 SENATE SUMMARY
19 Requires the Department of Highway Safety and Motor
Vehicles to revise the form of the uniform traffic
20 citation so that a law enforcement officer may indicate
on the citation if a traffic violation or accident was
21 caused by aggressive driving. Defines the traffic
offenses that constitute "aggressive driving." Requires
22 that the department report to the Legislature on February
1, 2002, the number of incidents of aggressive driving
23 which were reported during the previous 6 months.
