  1                      A bill to be entitled

  2         An act relating to insurance fraud relating to

  3         motor vehicles; amending s. 817.234, F.S.;

  4         providing penalties for certain acts; providing

  5         an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (13) is added to section

10  817.234, Florida Statutes, to read:

11         817.234  False and fraudulent insurance claims.--

12         (13)  A person who commits insurance fraud relating to

13  a motor vehicle shall serve a minimum mandatory prison term of

14  1 year. A person who intentionally participates in staging a

15  motor vehicle accident to defraud an insurer or other person

16  commits a felony of the second degree punishable as provided

17  in s. 775.082 or s. 775.083.

18         Section 2.  This act shall take effect July 1, 2001.

21                          SENATE SUMMARY

22    Provides that a person who commits insurance fraud
      relating to a motor vehicle shall receive a minimum
23    mandatory prison term of 1 year. Provides that a person
      who intentionally participates in staging a motor vehicle
24    accident to defraud an insurer or other person commits a
      felony of the second degree.
