  1                      A bill to be entitled

  2         An act relating to property or liability

  3         insurance contracts; providing that certain

  4         pollution-exclusion provisions may exclude only

  5         certain incidents and hazards; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  A clause in a property or liability

11  insurance contract that excludes coverage for damage caused by

12  the actual or threatened discharge or release of pollutants,

13  including smoke, vapor, soot, fumes, acid, alkalis, chemicals,

14  waste, or any other solid, liquid, gaseous, or thermal

15  irritant or contaminant may exclude from coverage only

16  incidents and hazards that involve long-term environmental

17  degradation or an environment-wide exposure.

18         Section 2.  This act shall take effect and shall apply

19  to policies entered into or renewed on or after August 1,

20  2001.
