14 On page 2, line 13, delete that line
15
16 and insert:
17 Section 3. Section 2 of this act take effect only upon
18 the effective date of legislation that makes any such
19 information provided to the Department of Health confidential
20 and exempt from section 119.07(1), Florida Statutes, and
21 section 24(a) of Article I of the State Constitution, until 10
22 days after probable cause is found that a violation of law
23 occurred. Such legislation must also provide that the
24 information is not discoverable or admissible in a civil or
25 administrative action and that such information may only be
26 used by the department or the Board of Pharmacy in a
27 disciplinary proceeding brought against the pharmacist or by
28 the department in any study of adverse incidents without
29 identifying the patient, pharmacist, pharmacy, office, or
30 entity by name, location, or other identifier.
31 Section 4. Except as otherwise provided in this act,
