  1                      A bill to be entitled

  2         An act relating to pharmacists; defining the

  3         term "pharmaceutical adverse incident" and

  4         requiring that such incidents be reported to

  5         the Department of Health; providing for the

  6         adoption of rules and forms; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  (1)  As used in this section, the term

12  "pharmaceutical adverse incident" means the dispensing of a

13  different medication, a different dose, or the correct

14  medication in a container with different instructions than

15  that specified in the prescription, but does not include the

16  dispensing of a generic equivalent medication with the

17  patient's consent.

18         (2)  A pharmacist licensed under chapter 465, Florida

19  Statutes, or other health care practitioner, as defined in

20  section 456.001, Florida Statutes, who becomes aware of a

21  pharmaceutical adverse incident must report such incident to

22  the Department of Health on forms provided by the department.

23         (3)  The Department of Health shall adopt forms and

24  rules for administering this section.

25         Section 2.  This act shall take effect July 1, 2001.
