  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Digital Divide Trust Fund within the Executive

  4         Office of the Governor; providing for sources

  5         of moneys and purposes; providing for future

  6         review and termination or re-creation of the

  7         trust fund; providing a contingent effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  The Digital Divide Trust Fund is hereby

13  created, to be administered by the Office of Information

14  Technology within the Executive Office of the Governor. Funds

15  shall be credited to the trust fund as provided in HB .... or

16  similar legislation, to be used for the purposes set forth

17  therein.

18         Section 2.  (1)  Pursuant to the provisions of Section

19  19(f)(2), Article III of the State Constitution, the Digital

20  Divide Trust Fund shall, unless terminated sooner, be

21  terminated on July 1, 2005.

22         (2)  Prior to the regular legislative session

23  immediately preceding the date on which the trust fund is

24  scheduled to be terminated, the Governor shall recommend to

25  the President of the Senate and the Speaker of the House of

26  Representatives whether the trust fund should be allowed to

27  terminate or should be re-created.  These recommendations

28  shall be based on a review of the purpose and use of the trust

29  fund and a determination of whether the trust fund will

30  continue to be necessary.  A recommendation to re-create the

31  trust fund may include suggested modifications to the

  1  purposes, sources of receipts, and allowable expenditures for

  2  the trust fund. The Governor's recommendation shall be made as

  3  a part of the recommended budget presented to the Legislature

  4  pursuant to section 216.162, Florida Statutes.

  5         (3)  If the trust fund is terminated, the Executive

  6  Office of the Governor shall pay any outstanding debts or

  7  obligations of the trust fund as soon as practicable and the

  8  Comptroller shall close out and remove the trust fund from the

  9  various state accounting systems, using generally accepted

10  accounting practices concerning warrants outstanding, assets,

11  and liabilities.

12         Section 3.  This act shall take effect July 1, 2001, if

13  HB .... or similar legislation is adopted in the same

14  legislative session or an extension thereof.
