18 and insert:
19 Section 65. Section s. 100.061, Florida Statutes, is
20 amended to read:
21 100.061 First primary election.--In each year in which
22 a general election is held, a first primary election for
23 nomination of candidates of political parties shall be held on
24 the Tuesday 9 weeks prior to the general election. Each
25 candidate receiving a majority or a plurality of at least 35
26 percent of the votes cast in each contest in the first primary
27 election shall be declared nominated for such office. A
28 second primary election shall be held as provided by s.
29 100.091 in every contest in which a candidate does not receive
30 such a majority or plurality.
31 Section 66. Section 100.091, Florida Statutes, is

1 amended to read:
2 100.091 Second primary election.--
3 (1) In each year in which a general election is held,
4 a second primary election for nomination of candidates of
5 political parties where nominations were not made in the first
6 primary election shall be held on the Tuesday 5 weeks prior to
7 the general election.
8 (2) The names of the candidates placing first and
9 second in the first primary election shall be placed on the
10 ballot in the second primary election for each contest in
11 which no candidate was declared to be nominated pursuant to s.
12 100.061 receives a majority of the votes cast in the first
13 primary election, subject to the following exceptions:
14 (a) In any contest in which there is a tie for first
15 place in the first primary election, only the names of the
16 candidates so tying shall be placed on the ballot in the
17 second primary election.
18 (b) In any contest in which there is a tie for second
19 place in the first primary election and the candidate placing
20 first was not declared to be nominated pursuant to s. 100.061
21 did not receive a majority of the votes cast, the name of the
22 candidate placing first and the names of the candidates tying
23 for second shall be placed on the ballot in the second primary
24 election.
25 (3) The candidate who receives the highest number of
26 votes cast for the office in the second primary election shall
27 be declared nominated. In case two or more persons receive an
28 equal and highest number of votes for the same office in the
29 second primary, such persons shall draw lots to determine who
30 will receive the nomination.
