2 An act relating to public records; creating s.
3 627.3111, F.S.; providing an exemption from
4 public records requirements for financial or
5 patient records of an insured or consumer in
6 records of the Department of Insurance and for
7 personal identifying information relating to
8 such persons; providing for future review and
9 repeal; providing a statement of public
10 necessity; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 627.3111, Florida Statutes, is
15 created to read:
16 627.3111 Privacy of insured; records.--Any records of
17 the department that are public records which contain financial
18 or patient records of an insured or consumer may be redacted
19 by the department prior to release so that the privacy of the
20 insured or consumer is preserved, and any portions of such
21 records that reveal the identity, home or employment telephone
22 number, home or employment address, or other personal
23 information of the insured or consumer are exempt from s.
24 119.07(1) and s. 24(a), Art. I of the State Constitution. This
25 exemption does not apply with respect to records of an insured
26 or other consumer who is the subject of a criminal
27 investigation. This section is subject to the Open Government
28 Sunset Review Act of 1995 in accordance with s. 119.15, and
29 shall stand repealed on October 1, 2006, unless reviewed and
30 saved from repeal through reenactment by the Legislature.

1 Section 2. The Legislature finds that there is a
2 public necessity that portions of records which reveal
3 personal financial or medical information of insureds and
4 other consumers be withheld from public inspection or
5 disclosure to protect the privacy of said insureds or
6 consumers.
7 Section 3. This act shall take effect on becoming a
8 law.
