17 Section 1. (1)(a) The Agency for Health Care
18 Administration is directed to create an Organ Transplant Task
19 Force within the Agency for Health Care Administration.
20 (b) Task Force participants shall be responsible for
21 only the expenses that they generate individually through
22 participation. The agency shall be responsible for expenses
23 incidental to the production of any required data or reports.
24 (2) The Task Force shall consist of up to 15 members.
25 The task force chairperson shall be selected by majority vote
26 of a quorum present. Eight members shall constitute a quorum.
27 The membership shall include, but not be limited to, a balance
28 of members representing the Agency for Health Care
29 Administration, existing organ transplantation health care
30 facilities, individual organ transplant health care
31 practitioners, organ procurement agencies and organ transplant

1 recipients or family members.
2 (3) The Task Force shall meet for the purpose of
3 studying and making recommendations regarding current and
4 future supply of organs in relation to the number of existing
5 organ transplantation programs and the future necessity of the
6 issuance of a certificate of need for proposed organ
7 transplantation programs. At a minimum, the Task Force shall
8 report back to the Legislature: a summary of the method of
9 allocation and distribution of organs; the number of Medicaid
10 and charity care patients who have received organ transplants
11 by existing organ transplant programs, as well as exploring
12 mechanisms to fund organ transplants which shall include but
13 not limited to an organ transplant trust fund for the
14 treatment of Medicaid and charity patients; the impact of
15 trends in health care delivery and financing on organ
16 transplantation; and the number of certificates of need
17 applications reviewed by the Agency for Health Care
18 Administration in the last five years, the number of
19 certificates of need approved or denied, and the number
20 litigated.
21 (4) The Task Force shall meet at the call of the
22 chairperson. The Task Force shall submit a report to the
23 Governor, President of the Senate, and the Speaker of the
24 House by January 15, 2002. The Task Force is abolished
25 effective December 31, 2002.
26 Section 2. This bill shall become effective July 1,
27 2001.
