14 On page 2, lines 6-16,
15 remove from the bill: all of said lines

17 and insert in lieu thereof:
18 (2) Notwithstanding the provisions of subsection (1),
19 if an architect, engineer, general contractor, subcontractor,
20 sub-subcontractor, or materialman or any combination thereof
21 provides service to or for a public agency, the agency may
22 require in a construction contract with such party that such
23 party indemnify and hold harmless the agency, its officers and
24 employees, and the agency's consultants and design
25 professionals from liabilities, damages, losses, and costs,
26 including, but not limited to, reasonable attorney's fees, to
27 the extent caused by the negligence, recklessness, or
28 intentionally wrongful conduct of such party and other persons
29 employed or utilized by such party in the performance of the
30 contract.
