14 On page 1, line 24, through page 2, line 5,
15 remove from the bill: all of said lines
16
17 and insert in lieu thereof: herein promises to indemnify or
18 hold harmless the other party to the agreement, contract, or
19 guarantee for liability for damages to persons or property
20 caused in whole or in part by any act, omission, or default of
21 the promisee arising from the contract or its performance
22 shall be void and unenforceable unless the contract contains a
23 monetary limitation on the extent of the indemnification which
24 shall be a part of the project specifications or bid
25 documents, if any. Indemnification provisions in any such
26 agreement, contract, or guarantee may not require that the
27 promisor indemnify the promisee for damages to persons or
28 property caused in whole or in part by any act, omission, or
29 default of a party other than:
30 (a) The promisor;
31 (b) Any of the promisor's contractors, subcontractors,

1 sub-subcontractors, materialmen, or agents of any tier or
2 their respective employees; or
3 (c) The promisee or its affiliated companies or their
4 respective officers, directors, or employees.
