14 On page 4, line 1, through
15 page 20, line 25, delete those lines

17 and insert:
18 Section 1. Paragraph (f) of subsection (37) of section
19 440.02, Florida Statutes, is repealed.
20 Section 2. Limitation on construction industry
21 business activities; penalties.--
22 (1) Notwithstanding any other provision of chapter
23 440, Florida Statutes, with respect to persons and entities
24 actively engaged in the construction industry, a corporation,
25 partnership, sole proprietorship, or independent contractor
26 that fails to maintain coverage or is otherwise without
27 coverage required by chapter 440, Florida Statutes, may not
28 enter into a contract, subcontract, or other business
29 relationship, for the purposes of construction, with another
30 corporation, partnership, sole proprietorship, or independent
31 contractor.

1 (2) Any sole proprietor or partner of a business
2 actively engaged in the construction industry who violates
3 subsection (1) shall immediately forfeit any election of
4 exclusion or election of exemption available under chapter
5 440, Florida Statutes, and may not elect or receive an
6 exclusion or exemption from the requirements of chapter 440,
7 Florida Statutes, for a period of 5 years following the date
8 of the violation.
9 (3) Any corporate officer of a corporation actively
10 engaged in the construction industry who violates subsection
11 (1) shall immediately forfeit any election of exclusion or
12 election of exemption available under chapter 440, Florida
13 Statutes, and may not elect or receive an exclusion or
14 exemption from the requirements of chapter 440, Florida
15 Statutes, for a period of 5 years following the date of the
16 violation.
