18         (e)  An eligible county shall use funds provided
19  pursuant to s. 212.20(6)(e)7.e. for the following purposes
20  only:
21         1.  Ten percent of such funds shall be reserved for use
22  in the Miami-Dade County brownfield revolving loan program, or
23  for use in a program of microloans or other loans to support
24  small businesses existing in the brownfield area in which the
25  significant new facility is located.
26         2.  Ten percent of such funds shall be reserved for a
27  contract between an eligible county and the United Way
28  organization serving such county, under which the United Way
29  organization agrees to administer a program to provide grants
30  to low-performing public schools in the county.
31         a.  To be eligible for a grant under this program, a

HOUSE AMENDMENT Bill No. CS/HB 1189 Amendment No. ___ (for drafter's use only) 1 school must be a public school in the eligible county that has 2 been classified as a "D" or "F" school under standards used by 3 the Department of Education for grading public schools as part 4 of the annual School Accountability Report. 5 b. Grant funds awarded under this subparagraph may be 6 used in any manner deemed by the school principal to be 7 reasonably related to the improvement of the school, provided, 8 however, that such grant funds must be used to directly 9 benefit students in kindergarten through third grade at the 10 school receiving the grant. 11 c. The United Way organization shall develop 12 application guidelines and criteria to be used in reviewing 13 applications, with such guidelines and criteria subject to 14 approval by the governing body of the eligible county. Such 15 application guidelines, at a minimum, must require a school 16 applying for funds under this subparagraph to submit a 17 school-improvement plan that explains in detail the proposed 18 use of grant funds and how such use will directly benefit 19 students in kindergarten through third grade. 20 d. No more than 5 percent of the funds reserved under 21 this subparagraph may be used for administrative costs 22 associated with the establishment and operation of this grant 23 program. 24 3. The remainder of such funds shall be used for the 25 public purpose of paying for, or pledging as security for or 26 paying debt service on bonds or other obligations issued to 27 finance, the costs of acquisition, site preparation, 28 infrastructure development, construction, reconstruction, 29 renovation, expansion, or rehabilitation of the qualifying 30 site and significant new facility to be located thereon, or 31 for the costs of infrastructure and other improvements outside 2 File original & 9 copies 04/27/01 hbd0001 04:17 pm 01189-0108-375689
HOUSE AMENDMENT Bill No. CS/HB 1189 Amendment No. ___ (for drafter's use only) 1 the boundaries of the qualifying site but which are necessary 2 or helpful to the development or operation of the significant 3 new facility, or for reimbursement of any such costs, and for 4 the costs incurred by it to remediate the qualifying site. 5 However, if in any fiscal year of the eligible county the 6 funds provided under s. 212.20(6)(e)7.e. are in excess of the 7 amount necessary in that fiscal year to pay for the costs 8 related to the bonds for the significant new facility and 9 qualifying site as authorized by this subparagraph and to pay 10 debt service on bonds or other obligations related only to the 11 costs of the bonds for construction of the significant new 12 facility issued to finance all or any part of such costs, such 13 excess funds shall be applied toward or set aside for the 14 redemption of any such bonds and paid to lower the principal 15 of the bonds. 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 3 File original & 9 copies 04/27/01 hbd0001 04:17 pm 01189-0108-375689
